Align Technology (”Align”) is a global medical device company engaged in the design, manufacture and marketing of the Invisalign® system, the pioneer and most technically advanced clear aligner system on the market, and of the iTero® intraoral scanners and services for orthodontic and restorative dentistry. Align’s innovative products help dental professionals achieve the clinical results they expect and deliver effective, cutting-edge dental options to their patients.

Align has operations throughout the EMEA region along with independent distributors in certain areas. Legal support for these operations was historically supported internally by the Global HQ legal team based in San Jose, California and by outside counsels in Europe. Over the last decade, Align has grown considerably and with this has come a gradual growth of the EMEA Legal department. With the recent establishment of a Regional EMEA legal structure, this new position Legal Counsel Russia has been created to provide legal support and coordination for Russia (with potential tangential support of surrounding countries).

The position of Legal Counsel Russia is a high profile and high visibility lead lawyer role, and will serve as the Align’s first legal counsel in Russia, providing advice to the commercial and functional leaders on a wide variety of commercial legal, regulatory and compliance matters as they arise from the day-to-day operations of a public global company, operating in a highly regulated sector and poised for significant growth.

The Legal Counsel Russia will have strong international experience gained in another medical device company or the healthcare team of a leading law firm. With strong business acumen, the Legal Counsel Russia will have the experience and gravitas to influence and negotiate with key internal and external stakeholders.

He/she will be based in Moscow (Russia) and will report to the Senior Legal Counsel EMEA located in Amsterdam, the Netherlands.

ESSENTIAL DUTIES AND RESPONSIBILITIES, in the area of:

The Legal Counsel Russia will interface with all disciplines and departments within Align supporting Russia. This will include, but not be limited to, commercial, corporate, regulatory, competition, and compliance support. This attorney will contribute to Align’s success by supporting all aspects of operations including review of marketing and sales programs, contract drafting and review, compliance programs and general legal support and advice.

The key missions will include:

• Lead responsibility for all sales, marketing, distribution, compliance and customer-facing legal matters / need for legal support in Russia, and additional support related to compliance with Russian personal data and privacy laws.
• Provide high quality legal and strategic advice and day-to-day support to the Russia commercial and other functional teams.
• Anticipate and address critical legal, business and ethical issues.
• Work closely with the Senior Legal Counsel EMEA and other members of the EMEA Legal Department, to create, develop, implement and maintain a risk-based compliance program with consistent and effective policies and procedure, that also reflect domestic laws, rules and culture.
• Advise and keep the Senior Legal Counsel EMEA updated on business management of critical projects in a timely manner and assist in reviewing all matters relating to compliance and financial reporting as appropriate.
• Work closely with the Russia HR Department on general employment issues or other issues common to HR and Legal.
• Plan and deliver risk-based training programs including interactions with HCPs, competition law, etc.
• Effectively establish and manage relationships with the Russia area and other Align’s external counsels.

• Keeps abreast of changes in laws and regulations that may affect the Russia area and/or Align operations.
• Experience with Russian personal data and privacy laws, experience with audits and investigations involving Roskomnadzor, and knowledge of related localization requirements.
• Identifies unmet needs and future challenges and proactively proposes strategies to optimize outcomes for Align in the Area.
• Impeccable business and risk management judgment and ethics.
• Confident team player and ability to develop relationships and networks at all levels.
• Experience of working with major US domiciled corporations and multicultural teams.
• Enjoy working in a challenging, fast paced and dynamic workplace.

EDUCATION and/or EXPERIENCE

5+ years minimum post-bar experience, ideally gained within healthcare/medical device environment or, alternatively with a top-tier law firm representing healthcare & technology clients.

SKILLS REQUIRED - LANGUAGE SKILLS:

Fluent in spoken and written Russian and English
